Terms and Conditions — Sweeney HVAC Solutions LLC

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Sweeney HVAC Solutions LLC ("Company," "we," "us," or "our"), a California limited liability company located at 12555 Parish Rd, San Diego, CA 92128. By requesting HVAC services from our company, using our website, submitting a service request form, or entering into a service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree to these Terms and Conditions, please do not use our website or request our services. We reserve the right to modify these Terms at any time. Continued use of our services after any modification constitutes your acceptance of the updated Terms.

2. HVAC Services

Sweeney HVAC Solutions LLC provides residential and commercial heating, ventilation, and air conditioning (HVAC) services including but not limited to: system repair, equipment installation, preventive maintenance, emergency service, indoor air quality solutions, ductwork services, thermostat installation, and energy efficiency consulting.

All HVAC services are performed by licensed, trained technicians in accordance with applicable California building codes, manufacturer installation requirements, and industry best practices. We reserve the right to decline service requests that we determine are outside our scope of expertise, geographic service area, or that present safety concerns that cannot be adequately addressed.

Our services are subject to availability. We make every effort to accommodate your scheduling preferences, but we cannot guarantee specific appointment times in all circumstances, particularly for emergency service calls where demand may be high.

3. Scheduling and Appointments

Service appointments are scheduled by mutual agreement between the Customer and Sweeney HVAC Solutions LLC. We provide appointment windows (typically 2–4 hours) rather than exact arrival times, as HVAC service calls can vary significantly in duration. We will make reasonable efforts to notify you if we are running significantly outside the scheduled window.

We ask that an adult (18 years of age or older) be present at the service location for the duration of the appointment. If no adult is present when our technician arrives, we may need to reschedule the appointment, and a trip charge may apply.

We ask that you provide reasonable access to all HVAC equipment that requires service, including outdoor condenser units, indoor air handlers, furnaces, thermostats, electrical panels, and any accessible ductwork. Failure to provide adequate access may result in an incomplete service call and may require a return visit.

4. Cancellations and Rescheduling

We understand that schedules change. We ask that you provide at least 24 hours' notice if you need to cancel or reschedule a non-emergency service appointment. Cancellations with less than 24 hours' notice may be subject to a cancellation fee. Repeated no-shows may result in a requirement for advance payment before scheduling future appointments.

We reserve the right to reschedule appointments due to technician illness, equipment failure, weather conditions that make service unsafe, or other circumstances beyond our control. In such cases, we will contact you as soon as possible to reschedule at a mutually convenient time.

5. Emergency Service Calls

Our 24/7 emergency HVAC service is available for situations involving immediate health or safety risks or significant equipment failures in extreme weather conditions. Emergency service calls are prioritized based on the severity of the situation and current technician availability.

Emergency service calls outside of standard business hours (Monday through Friday, 7:00am to 6:00pm, and Saturday 8:00am to 2:00pm) are subject to after-hours service fees in addition to standard diagnostic and repair charges. All applicable fees will be disclosed before the technician is dispatched.

Calling our emergency line for non-emergency situations is discouraged, as it may delay response to customers with genuine emergencies. We appreciate your cooperation in reserving emergency calls for true urgencies.

6. Estimates and Pricing

We provide written estimates for all HVAC services before beginning work. Estimates are based on the technician's diagnosis of your system at the time of the service call and the information available at that time. We will not begin any repair or installation work without your explicit approval of the estimate.

Estimates are valid for 30 days from the date of issuance unless otherwise noted. Prices are subject to change based on fluctuations in parts costs, labor rates, and market conditions. If a significant period of time passes between the estimate and the scheduled work, we may need to revise the estimate.

In some cases, the full scope of a repair may not be apparent until the repair is underway. If additional work is discovered during a repair that was not included in the original estimate, our technician will stop and consult with you before proceeding. We will never perform additional work without your approval.

Service call and diagnostic fees are charged for all service visits regardless of whether you choose to proceed with the recommended repairs. These fees cover the technician's time, travel, and diagnostic work.

7. Payment Terms

Payment for HVAC services is due upon completion of the service call unless otherwise agreed in writing. We accept cash, checks, and major credit cards (Visa, MasterCard, American Express, and Discover). Returned checks are subject to a returned check fee.

For larger installation projects, we may require a deposit of up to 50% of the total project cost before ordering equipment or beginning work. The remaining balance is due upon completion of the installation. Specific payment terms for large projects will be documented in the written project agreement.

Accounts that remain unpaid more than 30 days after the invoice date may be subject to late payment charges. Accounts referred to collection agencies will be responsible for all collection costs including reasonable attorney's fees. We reserve the right to withhold warranty service on accounts with outstanding balances.

8. Equipment and Parts

We install and use quality HVAC equipment and parts from reputable manufacturers. Unless otherwise specified in writing, we will select the appropriate equipment and parts based on our professional judgment regarding quality, compatibility, and value.

If you request specific equipment brands or models that differ from our standard recommendations, we will make reasonable efforts to accommodate your request. However, we cannot guarantee availability of specific products and we are not responsible for delays caused by special-order equipment.

Title to all equipment and parts installed by us remains with Sweeney HVAC Solutions LLC until full payment has been received. In the event of non-payment, we reserve the right to remove installed equipment in accordance with applicable law.

9. Warranties

Labor Warranty: We warranty our labor on all HVAC repairs for a period of 30 days from the date of service, unless a longer warranty period is specified in writing. If the same problem recurs within the warranty period due to a defect in our workmanship, we will return to correct the issue at no additional labor charge.

Parts Warranty: Parts and components carry the manufacturer's warranty, which varies by manufacturer and part type. Most HVAC parts carry a 1-year manufacturer warranty. We will assist you in pursuing warranty claims for parts that fail within the manufacturer's warranty period.

New Equipment Warranty: New HVAC equipment installations include the full manufacturer's equipment warranty, which we register on your behalf. Equipment warranties typically range from 5 to 10 years for parts, with some manufacturers offering extended warranties for registered equipment. Labor warranties on new installations are typically 1 year.

Warranty Exclusions: Warranties do not cover damage caused by customer misuse or abuse, failure to maintain the system in accordance with manufacturer recommendations, unauthorized modifications or repairs by others, acts of God or natural disasters, electrical surges or power quality issues, or normal wear and tear.

10. Intellectual Property and Website Usage

All content on the Sweeney HVAC Solutions LLC website, including text, graphics, logos, images, and software, is the property of Sweeney HVAC Solutions LLC or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, display, or create derivative works from any content on our website without our express written permission.

You may use our website for lawful purposes only. You agree not to use our website in any way that could damage, disable, overburden, or impair our website or servers, or interfere with any other party's use and enjoyment of our website. You agree not to attempt to gain unauthorized access to any portion of our website or any systems or networks connected to our website.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Sweeney HVAC Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or these Terms, even if we have been advised of the possibility of such damages. Our total liability for any claims arising out of or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

We are not responsible for pre-existing conditions in your HVAC system or property that are not related to the specific work we performed. We are not responsible for damage caused by deferred maintenance, aging equipment, or conditions that existed prior to our service.

We maintain comprehensive general liability insurance. In the event that our work causes damage to your property, please notify us immediately. We will work with you and our insurance carrier to address any legitimate damage claims.

12. Dispute Resolution

We are committed to resolving any disputes or complaints promptly and fairly. If you have a concern about any aspect of our service, please contact us directly at (760) 300-0573 or jashuasweeney@sweeneysol.com. We will make every reasonable effort to resolve your concern to your satisfaction.

If a dispute cannot be resolved through direct communication, the parties agree to attempt to resolve the dispute through non-binding mediation before resorting to litigation. The costs of mediation shall be shared equally by the parties.

Any legal action arising out of or related to these Terms or our services shall be brought exclusively in the state or federal courts located in San Diego County, California. You consent to the personal jurisdiction of such courts.

13. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

14. Termination

We reserve the right to refuse service to any customer for any lawful reason, including but not limited to: unpaid balances on previous invoices, abusive or threatening behavior toward our technicians or staff, unsafe property conditions, or repeated cancellations or no-shows.

Customers may terminate a service agreement at any time prior to the commencement of work, subject to any applicable cancellation fees. Once work has commenced, customers remain responsible for payment for all work completed up to the point of termination.
